1. Scope of use
Spartacus-idh is a site belonging to the Spartacus company (SARL with capital of 4,500 euros, whose registered office is located at 75 rue de Wattignies, 75012 Paris, France).
These general terms and conditions of sale apply to all sales concluded by the https://spartacus-idh.com website, subject to the specific conditions indicated in the product presentation.
Spartacus-idh reserves the right to modify these conditions at any time without prior notice.
2. Articles description
Printed works are subject to legal deposit and to current international legislation on books (particularly in terms of intellectual property).
The electronic books (or eBooks) sold on spartacus-idh are digital files containing intellectual works (mainly books) and intended to be downloaded for reading on personal computers and other electronic devices (tablets, IPADs, KINDLEs, dedicated readers, PDAs, smartphones, telephones, etc.). Downloading involves the transmission and reproduction, on a disk belonging to the customer, of a digital file incorporating the work chosen by the customer. Downloaded files are in PDF, EPUB, PRC or MP3 format, and feature specific navigation functions (hypertext, zoom, text search, personal annotations). E-books are protected by French and international copyright laws. In the absence of a license (e.g. Creative Commons) specifying other conditions of use, downloaded files are reserved for the exclusive use of the purchaser. They may not be resold, rented or transmitted free of charge beyond the family circle and the legitimate needs of private use; any representation or reproduction of these files, in whole or in part, outside the cases provided for in article L122-5 of the French intellectual property code, is strictly forbidden and would expose their owners to legal action.
To protect the rights of authors, articles purchased on spartacus-idh are personalized with data supplied by the customer (surname, first name, etc.) via a digital marking applied dynamically to each page or by a DRM system. A sign indicates to the buyer the protection system applied to the work.
3. Orders
All orders are placed exclusively via the www.spartacus-idh.com website. Payment is made when the order is placed.
To place an order on spartacus-idh.com, the customer must be at least 18 years old and have legal capacity or parental consent.
Clicking on the « Pay » button on the screen summarizing the order constitutes an electronic signature expressly certifying the customer's unreserved agreement to these general terms and conditions of sale and to the special conditions (in particular the unit price) specific to each file purchased. The customer hereby waives the right to invoke any contradictory document, in particular his own general terms and conditions of purchase.
The customer may abandon his order until payment has been confirmed.
Once the order has been placed, spartacus-idh will send the customer an e-mail confirming the order.
4. Product availability
Electronic articles are normally accessible to the customer 24 hours a day, 7 days a week, all year round. However, spartacus-idh reserves the right to temporarily close access without prior notice.
Spartacus-idh cannot be held responsible for technical problems beyond its control, such as connection problems due to the customer's Internet service provider (slowness or interruption) or computer problems due to the customer's hardware or software. Physical items are available according to the stocks indicated on the site. Under no circumstances will the customer be able to demand an item indicated as out of stock.
5. Price
Product prices are quoted in euros, inclusive of all taxes. All orders are invoiced and payable in euros.
In the case of physical works, any order placed on the site and delivered outside France may be subject to taxes and customs duties that are imposed when the package reaches its destination. These customs duties and taxes are the responsibility of the customer. Spartacus-idh is under no obligation to verify and inform the customer of applicable customs duties and taxes, and the customer is advised to contact the appropriate authorities for information.
In the case of e-books, since spartacus-idh is unable to verify the customer's address with certainty, VAT at the current rate is charged on all purchases.
6. Payment
The price is payable in full in a single instalment when the order is placed.
Payment for purchases is made by credit card (Visa, Eurocard / Mastercard), directly on the site, or by Paypal, or by cheque (sent to the head office; the order is validated as soon as the cheque has been cashed). The credit card transaction is carried out at the time the order is placed.
Once the credit card code has been entered, the order is confirmed and cannot be cancelled or refunded.
7. Download
A few minutes after payment of the order, an e-mail is sent to the customer with a single-use URL for downloading. This URL has a lifespan of 2 days. After this period, if the customer has not downloaded the file, he can request a new URL to be sent via his customer interface. In addition to the confirmation e-mail containing the download link, customers land directly on the book download page after their purchase. There are therefore two ways for customers to retrieve their digital book, either directly after purchase on the download page, or later via the download link received by e-mail.
8. Right of withdrawal
Purchases of electronic and paper books are firm and final. They cannot be exchanged, refunded or retracted.
However, if, despite the care taken by spartacus-idh in the preparation of e-books, an obvious defect in the file prevents the customer from consulting a book purchased in this way, the customer may, within two weeks of receiving the URL, send the defective file via this form and have a new file repaired by spartacus-idh sent to him. The customer thus benefits from the provisions of the legal guarantee, in particular those relating to the guarantee against hidden defects.
9. Personal data protection
The information requested from the customer is, in some cases indicated as such, necessary for processing and executing orders and constitutes proof of all transactions between spartacus-idh and its customers, and in other cases, useful for getting to know the customer and improving the services that may be offered on the site. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
Personal data is processed in compliance with the French Data Protection Act of January 6, 1978.

The products offered comply with current French legislation. The responsibility of spartacus-idh cannot be engaged in the event of non-respect of the legislation of the country where the product is downloaded. It is the buyer's responsibility to check with local authorities regarding the use of the products ordered.
11. Applicable law
These terms and conditions are governed by French law. Any dispute shall be brought before the competent courts of Paris (France), where the head office of Spartacus is located and where the sales contract between the parties is formalized.
